Résumé

The court held that converting two access paths on agricultural land into a fifteen-space rental car park was not a mere partial transformation under Art. 24(2) LAT. The project would markedly change the parcel's external appearance and introduce a wholly new commercial use. The court further noted that such a commercial parking facility is, in principle, not among the constructions permitted in the villa zone under Art. 26A LALAT. The challenge to the refusal of the project therefore failed.

Art. 24 al. 2 LAT; qualification of a project as a partial transformation and zoning compatibility. A transformation may be treated as partial only if it remains limited in scope and does not substantially alter the character, outward appearance, or function of the parcel. Where the intended works replace access paths by a parking lot for fifteen rental cars, the intervention is of such importance that it constitutes a materially new use and cannot be subsumed under a partial transformation (consid. 2). Moreover, a parking facility serving commercial activity does not, in principle, belong to the constructions permitted in a villa zone; the planning regime applicable to the zone must be respected (consid. 3).

Résumé

La transformation de deux chemins, situés en zone agricole et permettant l'accès d'une parcelle à une route, en un parking de quinze voitures de location, constituerait un changement d'affectation dont l'importance empêche qu'il puisse être qualifié de transformation partielle, au sens de l'article 24 alinéa 2 LAT, notamment en raison de la modification notable de l'apparence extérieure de la parcelle et de son usage économique entièrement nouveau. En outre, la création d'un parking destiné à des activités commerciales n'entre en principe pas dans la catégorie des constructions autorisées dans la zone villas, zone dont les normes doivent être respectées en application de l'article 26A LALAT.
