The dispute concerned the meaning of “respondent” for a minor student’s study allocation. The court held that the relevant respondent is the parent who has custody of the child. In the case at hand, that was the mother, even though the child lived with the father. The parent’s custodial status, not the child’s actual residence, was decisive under LEE 8(1)(a).
LEE.8 al.1 litt.a; notion of respondent in the allocation of study aid for a minor; the respondent is the parent holding custody of the child. Actual residence of the child with the other parent does not prevail over custody for determining the respondent status. The custody criterion is decisive and excludes a purely factual residence-based approach.
