Résumé

The court held that unduly paid social insurance benefits may not be reclaimed by analogy to Art. 47 AVS where the insured acted in good faith and repayment would cause financial hardship. Finding both conditions met, it annulled the fund's reimbursement decision.

Reimbursement may not be ordered where the recipient could reasonably rely on the correctness of the payment and repayment would endanger the person's financial situation. Résumé

La restitution de prestations non dues ne peut être exigée de l'assuré, selon les règles découlant de l'article 47 LAVS applicable par analogie, si ce dernier était de bonne foi et si un tel remboursement le placerait dans une situation financière difficile. Cas dans lequel le Tribunal a admis la réalisation de ces deux conditions et a annulé la décision de la caisse tendant au remboursement des indemnités versées par erreur.
