Résumé

The court held that a building permit conforming to a development zone may not be granted before the Conseil d'Etat has issued the decree authorizing application of the zone's norms. It further held that the statute establishing the development zone cannot be subjected to incidental judicial review in the permit proceedings.

Regest

LGZDI.4; a building permit based on a development zone may be granted only after the competent executive authority has adopted the decree making the zone's special norms applicable. In the absence of that decree, the norms are not yet enforceable for permitting purposes. A statute instituting a development zone is not amenable to incidental review in proceedings concerning an individual building permit; the legality of the legislative act must be challenged by the appropriate direct avenue, not collaterally (consid. unspecified).
