A vehicle-rental activity was carried out in an already authorized pavilion situated in an agricultural zone. The court held that this use was not conforming to the zone under Art. 24(1) LAT. It therefore upheld the annulment of the authorization for the change of use. The appeal was dismissed.
Art. 24 al. 1 LAT; use of a building in an agricultural zone for a vehicle-rental business is not zone-conforming. An authorized structure does not justify any commercial use; a change of use remains subject to the requirements of non-conforming use only if the statutory conditions are met. Where the new activity is incompatible with the agricultural zone, the authority must refuse or annul the authorization. The decisive criterion is the objective compatibility of the actual activity with the zone purpose, not merely the existence of a formally authorized building (consid. unspecified).
