Résumé

The insured person, covered under a collective daily allowance arrangement, claimed benefits after the end of a seasonal employment contract. The court held that entitlement to daily allowances lasted only as long as the individual employment contract, which in this case covered only a few weeks of strawberry picking. The appeal was therefore dismissed.

Regest

Art. 67 LAMal; collective daily allowance insurance and duration of entitlement: coverage under a collective daily allowance scheme is, absent contrary contractual or statutory provisions, linked to the existence and duration of the individual employment relationship. For seasonal work, the right to benefits ends with the employment contract; the insured cannot derive an extension of coverage beyond that period merely from the collective nature of the insurance (consid. not specified).
