Résumé

The court held that, when calculating impairment compensation under Art. 24(1) LAA, the existing impairment of the right eye had to be taken into account. Because the appellant had already suffered damage to the right eye and then lost a substantial part of the vision in the left eye in an accident, the degree of impairment was assessed as greater. The compensation was therefore increased to CHF 63,180.

Art. 24 al. 1 LAA; determination of impairment compensation where the insured person already suffers from a pre-existing impairment of another organ, here an eye: the assessment of the loss of physical or mental integrity must be made taking into account the combined functional impact of the accident-related damage and the prior impairment. If the pre-existing condition increases the overall effects of the accident, it must be reflected in the IPAI calculation; an isolated assessment of the newly caused damage alone is impermissible.
