ATA/450/1997 ΓÇó Status of old quartier regulations and scope of definitive permit
ATA/450/1997Cour de justice / Chambre administrative5 août 1997
The case concerns a building project in which a definitive permit differed only slightly from a preliminary permit, by adding garages and swimming pools. The court held that these changes did not destroy the identity of the project between the two authorizations. It also held that norms contained in quartier regulations annexed to an aménagement plan are not zoning plans when they were not subjected to public inquiry. Finally, a communal development plan and quartier regulation from 1938 that were never published cannot be treated as binding zoning plans.
Art. 146 al. 1 LCI; distinction between preliminary and definitive building authorizations; a minor modification of a project in the definitive permit, such as the addition of garages and swimming pools, does not affect identity of subject-matter. Norms contained in quartier regulations annexed to an aménagement plan are not plans d'affectation where they have not been submitted to public inquiry. An old communal plan and quartier regulation, never published, cannot acquire binding force as zoning plans merely by virtue of their age or annexed form.
