An association challenged a final construction permit for a horticultural/rose-growing installation. The court held that, under Art. 146(1) LCI, the appeal against the final permit cannot revisit matters already approved by a final preliminary permit. However, because the preliminary permit had been published in the FAO as an ordinary permit rather than as a derogatory one, the publication was misleading and the preliminary permit could be held inopposable to the association. On the merits, the claimed need for on-site residence was rejected: the horticultural tasks did not objectively require the operator to live outside the building zone.

Aux termes de l'art. 146 al. 1 LCI, le recours dirigé contre une autorisation définitive de construire, précédée d'une autorisation préalable en force, au sens de l'art. 5 al. 1, ne peut porter sur les objets tels qu'agréés par celle-ci. Une autorisation de construire préalable entrée en force dont la publication dans la FAO ne respecte pas les conditions de l'art. 3 LCI est susceptible d'être déclarée inopposable à la partie qui recourt contre l'autorisation définitive fondée sur cette préalable. Le fait que l'autorisation préalable n'ait pas été délivrée sur une base dérogatoire, mais ordinaire, et publiée comme telle dans la FAO, était de nature à induire en erreur l'association recourante, qui ne peut se voir opposer le fait de n'avoir pas recouru avant l'autorisation définitive.
