Résumé

The appellant in a road-traffic speeding case did not comply with two court requests to file the challenged decision and evidence supporting his claim that another person was driving. He also failed to provide any employer certificate or other proof showing he could not have committed the offense. The court therefore treated his silence as a refusal to cooperate and found that, in light of all the circumstances, the appellant was sufficiently identified as the offender.

Art. 27 al. 1 LCR; duty to cooperate in the establishment of the facts in road-traffic proceedings. Where the person concerned, despite repeated requests, does not produce the documents necessary to support an exculpatory version and offers no other objective evidence, the authority may draw adverse inferences from the procedural attitude. A mere assertion that another person was driving is insufficient if it remains unsubstantiated; refusal to cooperate may justify finding the identity of the offender established on the basis of the overall circumstances.

Résumé

"En l'espèce, malgré les deux demandes qui lui ont été faites pour qu'il dépose la décision entreprise ainsi qu'une attestation du conducteur prétendu au moment de l'infraction, le recourant s'est contenté de ne pas répondre au Tribunal de céans. Il n'a pas non plus tenté de démontrer la réalité de la thèse qu'il soutenait en fournissant, le cas échéant, une attestation de son employeur prouvant qu'il était à son poste de travail au moment des faits ou tout autre document qui permettrait d'établir que le recourant ne pouvait avoir commis l'infraction qui lui est reprochée. Il y a donc lieu de considérer que le recourant se refuse en réalité à collaborer à la procédure administrative et la juridiction de céans considérera qu'il est suffisamment établi que le recourant est l'auteur de l'infraction qui lui est reprochée, au vu de toutes les circonstances de l'espèce".
