Résumé Omnilex

OLS fixed the effective date of a housing-subsidy modification at the first day of the month after the family reported a child’s birth. The decision held that this was improper: under Article 11(3) RLGL, the relevant date is the date of the change itself, not the date of notification. Because the child’s birth altered the family composition, the effort rate had to be reassessed and the surcharge removed starting the first day of the month after the birth.

Regeste Omnilex

Art. 11 al. 3 RLGL; housing surcharge and reassessment of effort rate following a change in family composition. The legal effect of a relevant change is determined by the date on which the modification occurs, not by the later date of its notification. A child’s birth constitutes such a modification and obliges the authority to recalculate the effort rate and to abolish the surcharge from the first day of the month following the birth; a later effective date based solely on delayed reporting is an unlawful penalty.

Question juridique clé

Whether the housing surcharge and effort rate must be adjusted from the first day of the month following the actual birth date or only from the month after late notification.

Solution extraite

The decisive date is the date of the change itself, not the date on which it is announced; the surcharge had to be lifted from the first day of the month following the birth.

Motifs extraits

A child’s birth changes the family composition and requires a reassessment of the effort rate. Article 11(3) RLGL ties the legal effect to the modification, not to the delay in reporting it; using the announcement date would amount to an unjustified penalty.
