The applicant sought revision of a decision relating to the revocation/termination of a commune employment relationship governed by private law. The court held that one cannot infer a different result merely because the court was unaware of a legal basis that might have changed its assessment, when that basis did not fall within the provisions applicable to the dispute. The revision request was therefore dismissed.
LPA art. 80; revision of a judgment for overlooked legal basis or decisive element: revision is unavailable where the asserted legal basis does not belong to the set of provisions applicable to the dispute, since in such a case it cannot be concluded that the court would probably have decided differently. A mere assumption that knowledge of an additional norm might have influenced the court is insufficient; the overlooked element must be relevant under the governing law and capable of affecting the dispositive outcome.
