Résumé

The applicant sought revision of a judgment that had confirmed the provisional seizure of weapons at his home. He argued that his clean criminal record and a certificate of good conduct were new facts. The court rejected the request, holding that these elements were not new and important within the meaning of the revision rules because they did not address the grounds on which the seizure had been ordered. The seizure therefore remained confirmed.

Regest

Art. 80 let. b LPA; revision on the basis of new facts and evidence; a certificate of good conduct and a clean criminal record do not constitute new and important facts where they do not relate to the reasons underlying the challenged seizure measure. Revision is admissible only if the asserted circumstances are both new and capable of altering the assessment that led to the decision; purely personal circumstances already compatible with the original grounds are insufficient.
