Résumé

The case concerns the construction of a villa in agricultural zone. The court states that personal reasons of the owner are irrelevant for authorization under Art. 24 LAT and that a villa is not imposed by its destination in agricultural zone. The existence of another non-conforming building does not justify increasing land use contrary to the zoning purpose, nor does it allow additional non-conforming installations. The cited precedent ATF 114 Ib 317 is applied to reject such an extension of deviation permissions.

A building unrelated to agricultural use cannot be authorized merely because the land already contains a non-conforming structure; an existing unlawful or non-conforming use does not justify further intensification of land use contrary to zoning. The exception must be interpreted restrictively, and the presence of a prior non-conforming installation does not create a right to additional non-conforming constructions (consid. 1).

Les motifs personnels de mise en valeur du bien-fond ne sont pas pertinents pour autoriser la construction de villas en zone agricole. Une telle construction n'est pas imposée par sa destination en zone agricole. La présence d'une construction non conforme à l'affectation de la zone ne justifie pas l'accroissement de l'utilisation du sol étrangère à cette affectation. Elle ne peut dès lors pas entraîner que l'implantation d'autres installations non conformes soient imposées par leur destination (ATF 114 Ib 317).
