Résumé

The cantonal court accepted the judicial expert report and held that the insured person's earning incapacity after the accident amounted to 67%, situated between the CNA's 35% estimate and the AI's 100% estimate. It also found that the CNA's economic survey was rather summary because only one company had been contacted, but the resulting salary ceiling of CHF 3,000 per month nevertheless lay within a realistic range for a comparable hypothetical activity.

Résumé

Sur la base de l'expertise judiciaire, le TA a admis un degré d'incapacité de gain de 67 %, à mi-chemin entre ce que prévoyait la CNA (35 %) et l'AI (100 %). L'enquête économique effectuée par la CNA est qualifiée de sommaire (une seule entreprise contactée), mais le plafond du salaire mensuel, fixé à Fr. 3'000.-, se situe dans une moyenne tout à fait réaliste des possibilités offertes dans un cas de figure similaire.
