The court confirmed SCARPA's refusal to resume maintenance advances. It held that compulsory enforcement against the debtor could not legally be pursued, so the conditions for resuming advances were not satisfied. SCARPA had timely initiated the procedure required under the New York Convention, and therefore could not be faulted.
LARPA art. 8a; resumption of maintenance advances presupposes the possibility of taking legally available enforcement measures against the debtor. Where enforcement abroad is impossible and the competent authority has timely initiated the procedure required by the New York Convention, the advance-paying authority bears no fault and the refusal to resume advances must be upheld.
