LARPA.11; suppression of maintenance advances on account of durable insolvency: unemployment may, depending on the circumstances, constitute a lasting inability to pay where it is accompanied by a sustained absence of seizable income and no concrete prospect of improvement in the near future. The decisive factor is not the debtor's abstract employability or willingness to work, but whether the current financial situation, assessed concretely, allows the continuation of advances. Where the opposing party adduces no elements showing a prompt change, durable insolvency may be affirmed (consid. implied).

Résumé
Le fait que le débiteur soit au chômage et depuis deux ans au bénéfice de prestations insaisissables de l'OCPA, démontre à satisfaction de droit que son insolvabilité est durable. Ni la recourante, ni son ex-mari lors de son audition n'ont amené d'élément concret permettant de penser que cette situation pouvait changer à brève échéance. "Certes, par définition, une situation de chômage est transitoire et il faut espérer que M. L. retrouvera un emploi. Il n'en reste pas moins qu'une situation de chômage est malheureusement susceptible dans certains cas d'entraîner une insolvabilité durable. Cette constatation, qui ne constitue en aucune manière une appréciation du SCARPA ou du Tribunal de céans sur la volonté ou la capacité du débiteur des pensions alimentaires de retrouver un emploi, a d'ailleurs été faite à différentes reprises par le Tribunal de céans (ATA du 6.09.1994 en la cause G.; du 3.05.1994 en la cause St.)".
