In a social insurance dispute concerning occupational pension assets after the death of the insured wife, the court held that the deceased's mother had to be joined as a party. The mother had been designated in the wife's testament as sole beneficiary of the LPP funds, and the outcome of the case would directly determine whether the husband could claim rights to those funds. Résumé

En vertu de son règlement, la fondation de prévoyance pouvait attribuer les fonds LPP de la part employeur à la mère de la défunte pour des raisons d'équité, vu la situation personnelle et financière de cette dernière. En l'espèce, la situation juridique de la mère de la défunte épouse du demandeur est directement touchée par l'issue de la procédure en cause, car cette dernière déterminera si le demandeur a des droits sur les fonds LPP de sa défunte épouse alors même que celle-ci avait désigné dans son testament sa mère comme unique bénificiaire. Elle doit donc être appelée en cause.
