Résumé

The court held that Geneva cantonal benefits granted in cases of temporary total or partial incapacity to work (PCMM) must be assimilated to daily allowances of sick funds and private sickness and accident insurers when these are paid in lieu of salary within the meaning of Art. 7 para. 1 lit. b OLAA. The decision turns on the functional equivalence of the benefits to salary-replacement daily allowances.
