The court held that Geneva cantonal benefits granted in cases of temporary total or partial incapacity to work (PCMM) must be assimilated to daily allowances of sick funds and private sickness and accident insurers when these are paid in lieu of salary within the meaning of Art. 7 para. 1 lit. b OLAA. The decision turns on the functional equivalence of the benefits to salary-replacement daily allowances.
Art. 7 al. 1 let. b OLAA; assimilation of cantonal benefits to salary-replacing daily allowances: cantonal prestations in case of temporary total or partial incapacity to work are to be treated, for the purposes of accident-insurance coordination, as daily allowances of sickness funds and private sickness and accident insurers paid in lieu of salary. Decisive is the functional equivalence of the benefit to a wage substitute; nomenclature or cantonal origin is not determinative.
