Résumé

The appeal concerned a planned development of eight villas. The court upheld the planning authority's handling of access, held that there was no reason to assume that noise exposure limits would be exceeded, and found that DTPE had not abused its discretion by not ordering a noise forecast under Art. 25 LPE. It also held that the opponents had not shown that the villas would fail to integrate into the built villa environment. The appeal was dismissed.

Where the file contains no concrete indications that limit values for noise immissions will be exceeded, the authority is not required to order a noise forecast. The competent authority does not exceed its discretion by abstaining from additional prognostic measures in such circumstances. Objections against access and architectural integration must be substantiated; a mere assertion that a project does not fit into the surrounding built fabric is insufficient.

Résumé

Accès à un futur groupe de 8 villas jugé suffisant par le TA. Il n'existe aucune raison de présumer que les limites d'exposition au bruit sont dépassées. Le DTPE n'a pas outrepassé son pouvoir d'appréciation en ne demandant pas un pronostic de bruit (25 LPE). Les opposants au projet n'ont pas démontré en quoi les futures villas ne s'intégreraient pas dans un site bâti de villas.
