The court held that a fracture of the cartilage of the femoral trochlea falls within the category of injuries assimilated to an accident under Art. 9(2) OLAA. It interpreted the notion of fracture in a broad, general sense, as referring to the bone as a whole and not requiring any distinction based on the specific tissues composing it.
Art. 9 al. 2 OLAA; interpretation of the term “fracture” in the catalogue of injuries assimilated to accident: the notion is to be understood in a general sense as relating to the osseous structure as a whole, without distinguishing the tissues of which it is composed. A fracture of the cartilage of the femoral trochlea therefore falls within the statutory concept of assimilated injury. The provision is construed according to its general meaning and not restricted by a histological differentiation (consid. implicit).

Résumé
La fracture du cartilage de la throchlée fémorale constitue une lésion assimilée à un accident au sens de l'article 9 alinéa 2 OLAA. Il faut interpréter le terme de fracture au sens de cette disposition comme se rapportant à la totalité de l'objet "os" sans spécification quant à la nature des tissus qui le composent.
