Résumé

The dispute concerned whether a pension fund could reduce its occupational pension benefits for alleged overinsurance by deducting AI benefits paid to compensate the insured person's incapacity to perform household work. The court held that such AI benefits do not cover the same loss and therefore cannot be offset. It further ordered the pension fund to pay moratory interest on the overdue benefits.

OPP.2 24; overinsurance in occupational pension benefits does not permit deduction of disability insurance benefits intended to compensate incapacity in household activities, since such prestations do not correspond to the same insured loss. Where the fund remains in default, moratory interest is owed on the overdue pension benefits.
