Uncontested allegations may be accepted despite defendant silence

Résumé

In a social-insurance administrative dispute, the defendant did not submit conclusions. The tribunal held that this passivity did not prevent the applicant from obtaining recognition of his rights. It considered that plausible allegations not contested by the defendant could be accepted as established, even if Article 22 LPA did not strictly apply to a non-answering respondent.

Art. 22 LPA; effect of a defendant's failure to take conclusions in administrative proceedings. Even where the formal conditions of Article 22 LPA are not fully met against a passive respondent, the authority must not let mere silence defeat the applicant's right to relief. It may treat as established factual allegations that are plausible and remain uncontested. A party's inactivity therefore does not in itself preclude judicial recognition of rights when the file contains sufficiently credible, unopposed submissions.

Résumé

Même si l'article 22 LPA ne semble pas s'appliquer au défendeur qui ne prend pas de conclusions dans le cadre d'une demande interjetée à son encontre, sa simple passivité ne doit pas empêcher le demandeur d'obtenir la reconnaissance de ses droits. Le Tribunal administratif peut donc considérer comme avérés les allégués du demandeur qui sont vraisemblables et non contestés par le défendeur.
