CNA may end gratuitous hospital-cost practice, but not here

Résumé Omnilex

The court held that CNA could generally stop its former practice of reimbursing all non-medical hospital costs of an insured who had become entitled to an AI pension. However, in the concrete case, the principle of good faith prevented CNA from applying the change against the insured because CNA already had a French judgment against the tortfeasor's liability insurer for reimbursement of part of those costs. Had CNA not paid them under its old practice, the insured could have claimed them directly in the French proceedings; he could not be required to restart litigation abroad.

Regeste Omnilex

Question juridique clé

Whether CNA could unilaterally end its practice of reimbursing all non-medical hospital expenses once the insured started receiving an AI pension.

Solution extraite

As a matter of principle, CNA was entitled to discontinue that gratuitous practice.

Motifs extraits

The insurer was not bound in perpetuity to maintain a payment practice that went beyond the statutory framework solely because the insured later received an AI pension.

Question juridique clé

Whether the principle of good faith prevented CNA from changing practice in this case because of the French third-party liability judgment and the insured's ability to assert the costs directly there.

Solution extraite

Yes. In the concrete circumstances, CNA could not rely on the change of practice against the insured.

Motifs extraits

CNA already held a French judgment obliging the liability insurer of the tortfeasor to reimburse part of the claimed costs, including the gratuitously paid items. If CNA had not paid them under the former practice, the insured could have asserted them directly in the French proceedings. Fairness and reliance protected the insured from having to start over in France.
