The case concerned an accident-insured building worker who suffered a non-occupational accident. The court accepted that he had full capacity for adapted work from a physical standpoint, but held that the psychiatric complaints stemming from a compensation tendency were not in adequate causal relation to the accident. It confirmed an invalidity degree of 30%. The court also held that the insurer could not rely on the OFIAMT wage survey of October 1992 to calculate invalidity, because the survey reflected average wages and did not account for the insured's individual functional limits.

An insured person's invalidity must be determined with regard to the concrete residual work capacity in adapted employment and the individual functional limitations. Psychological complaints are not compensable where the adequate causal link to the accident is lacking, even if they are described as a sinistrose tendency. Statistical wage surveys may serve only as auxiliary evidence; they cannot be used as decisive basis for the invalidity calculation if they do not reflect the insured's specific restrictions and earning capacity.

Pour calculer le degré d'invalidité de son assuré, l'assurance ne peut se fonder sur l'enquête de l'OFIAMT concernant les salaires et traitements versés en octobre 1992, car il s'agit de salaires moyens ne tenant pas compte des limites particulières des capacités d'un assuré accidenté.
