Résumé

The case concerns the refusal of a housing allowance to a tenant who moved into a more expensive apartment in order to accommodate the desire for a second child. The court held that Article 39A LGL permits such a refusal because the inconveniences relied on by the tenant do not constitute major inconveniences within the meaning of that provision.

Regest

Art. 39A LGL; refusal of housing allowance after a move to a more expensive dwelling: the authority may deny the benefit where the tenant chose more costly accommodation for personal or family preferences, unless the inconveniences invoked reach the threshold of major hardship required by the provision. Reasons linked to the wish for a second child do not, as such, satisfy that threshold. The assessment turns on whether the move was necessitated by circumstances of sufficient gravity; absent such circumstances, the denial of the allocation is lawful.
