The CRPP held that it was competent to review an appeal against a provisional suspension decision, even though the police law did not expressly provide for such a remedy. Relying on Administrative Court case law concerning provisional suspension of civil servants, it treated the measure as an incidental decision capable of causing irreparable harm. On the merits, the commission found that the unpaid provisional suspension of a police officer suspected of drug consumption respected proportionality and therefore remained in force.

Even in the absence of an express statutory remedy, a provisional suspension without pay is amenable to review where it constitutes an incidental decision likely to cause irreparable harm to the person concerned. In disciplinary matters, the authority must weigh the seriousness of the alleged misconduct and the interests of the service; the interim measure is lawful if it is suitable and not excessive at the provisional stage (consid. related to competence and proportionality).

Résumé
Le recours auprès de la CRPP contre une décision de suspension provisoire n'est pas expressément prévu par la LPol. Appliquant la jurisprudence du TA en matière de suspension provisoire d'un fonctionnaire (ATA X. du 2 mars 1993), la CRPP admet sa compétence pour connaître de la suspension provisoire d'un officier. Celle-ci constitue une décision incidente susceptible de causer un préjudice irréparable à l'intéressé. En l'espèce, respecte le principe de la proportionnalité, la suspension provisoire sans traitement de l'officier de police auquel il est reproché d'avoir consommé de la drogue.
