Résumé Omnilex

The appellant challenged a cantonal social insurance decision before the Federal Insurance Court. The court ordered an advance on costs, granted two extensions, and warned of non-entry if payment was not made. As the advance remained unpaid by the final deadline, the court did not enter into the administrative appeal. It also decided, in line with its practice, that no court costs would be levied for this non-entry decision.

Regeste Omnilex

Art. 134 OG e contrario, Art. 150 Abs. 4 OG; failure to pay the ordered advance on costs despite threatened consequence leads to non-entry. In proceedings that are in principle costs-bearing, the court may, after expiry of the final extended time limit and absent payment, refuse to enter into the appeal when the advance was duly ordered and the sanction of non-entry was announced. In such non-entry decisions for non-payment of the advance, court costs are, as a matter of practice, not imposed (consid. 1-2).

(Entscheid vom 7. August 2006)

In Erwägung,

Question juridique clé

Whether the administrative appeal had to be entered into despite non-payment of the advance on costs.

Solution extraite

No. Because the ordered advance was not paid within the final extended deadline, the court could not enter into the appeal.

Motifs extraits

The case was not about insurance benefits and was therefore costs-bearing. After a payment order, two deadline extensions were granted, but the advance remained unpaid; the court therefore applied the threatened consequence under the OG.

Question juridique clé

Whether court costs should be charged for the non-entry decision.

Solution extraite

No court costs were imposed in practice for a non-entry decision caused by failure to pay the advance.

Motifs extraits

Although the proceeding was in principle subject to costs, the court stated that its practice is not to levy court costs in non-entry decisions based on missing or late advance payment.
