Résumé Omnilex

The Federal Supreme Court held that the appellant’s complaint in an invalidity insurance case did not satisfy the federal reasoning requirements. She failed to address the decisive considerations of the cantonal insurance court and instead repeated her own assessment and relied on medical reports without engaging with the challenged reasoning. The Court therefore declined to enter into the complaint in simplified procedure. Given the circumstances, it waived court costs.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; admissibility of a federal appeal requires specific engagement with the reasoning of the challenged decision. The appellant must, in concise form, show how the contested judgment violates federal law; a merely appellatory recapitulation of the party’s own view or of earlier submissions is insufficient (consid. 1). Where the appeal fails to address the decisive grounds of the lower court, the presiding judge may refuse entry in simplified procedure. Under Art. 66 Abs. 1 sentence 2 BGG, costs may be waived exceptionally in view of the circumstances.

Urteil vom 31. Januar 2012
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiberin Keel Baumann.

Verfahrensbeteiligte
C.________,

gegen

IV-Stelle des Kantons Aargau, Kyburgerstrasse 15, 5000 Aarau,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

November 2011,

in Erwägung,

Question juridique clé

Whether the appeal met the statutory reasoning requirements under Art. 42 BGG

Solution extraite

The appeal did not sufficiently engage with the decisive reasons of the cantonal judgment and merely repeated the appellant’s own view and medical assessment.

Motifs extraits

A federal appeal must state requests and reasons and explain concretely how the challenged decision violates the law; this requires engagement with the lower court’s reasoning. That standard was not met here, especially as the appellant ignored the cantonal court’s treatment of the medical reports.

Question juridique clé

Whether court costs should be charged despite the non-entry decision

Solution extraite

Court costs were waived in the circumstances.

Motifs extraits

Because the case was decided in simplified procedure and the circumstances justified it, the court dispensed with costs under Art. 66 Abs. 1 Satz 2 BGG.
