Résumé Omnilex

The Federal Supreme Court did not enter into the appellant's appeal against the Zurich Social Insurance Court judgment because the filing failed to satisfy the minimum reasoning requirements of Art. 42 BGG. Instead of engaging with the lower court's decisive reasoning, the appellant mainly discussed her divorce and criticized her psychiatrist and legal aid counsel. The court decided the matter under the simplified procedure of Art. 108 BGG and waived court costs under Art. 66 Abs. 1 BGG.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b and Abs. 2 BGG; non-entry for insufficient reasoning: an appeal must, in concise form and by reference to the decisive considerations of the challenged decision, demonstrate how the decision violates federal law. Submissions that merely restate the appellant's personal situation or criticize third persons without engaging with the lower court's reasoning do not satisfy this minimum threshold and may be disposed of in simplified procedure under Art. 108 BGG (consid. 1). Costs may exceptionally be waived under Art. 66 Abs. 1 BGG where the circumstances so justify (consid. 2).

August 2013,

in Erwägung,
