Résumé Omnilex

The appellant sought to set aside two decisions of the AI office for insured persons residing abroad. After an order requiring production of the challenged decision, he filed only another copy of his appeal brief. The Federal Supreme Court held that the appeal was inadmissible for failure to comply with the submission requirement and, independently, for lack of sufficient reasoning. The court decided the case in simplified procedure and waived judicial costs.

Regeste Omnilex

Art. 42 al. 2 and 5 LTF; Art. 97 al. 1 LTF; Art. 108 al. 1 let. a and b LTF; inadmissibility of an appeal for failure to produce the contested decision and for insufficient reasoning. The appeal brief must contain a reasoned request and, where required by order of the court, the challenged decision must be filed within the set time limit; otherwise, the appeal is not entered into. Mere repetition of submissions does not satisfy the duty to state briefly why the lower judgment violates federal law or rests on manifestly incorrect fact-finding. In such a case, the court may decide under the simplified procedure.

Arrêt du 31 octobre 2011
IIe Cour de droit social

Composition
M. le Juge U. Meyer, Président.
Greffier: M. Berthoud.

Participants à la procédure
A.________,
recourant,

contre

Question juridique clé

Whether the appeal was admissible despite failure to produce the challenged decision.

Solution extraite

No. The appeal was inadmissible because the appellant did not submit the challenged decision within the set deadline.

Motifs extraits

The appellant was expressly warned that the appeal would not be considered absent the decision. He submitted only another copy of his appeal brief, which is insufficient under Art. 42(5) LTF and warrants simplified inadmissibility under Art. 108(1)(a) LTF.

Question juridique clé

Whether the appeal met the requirements of a reasoned appeal under federal procedural law.

Solution extraite

No. The submissions did not explain why the lower court's findings were incorrect or why the contested decision violated the law.

Motifs extraits

The written submissions contained no indication of error in fact-finding under Art. 97(1) LTF and no legal argument satisfying Art. 42(2) LTF, so inadmissibility also followed under Art. 108(1)(b) LTF.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No judicial costs were charged.

Motifs extraits

Given the procedural posture, the court exercised its discretion under Art. 66(1), second sentence, LTF to waive costs.
