Résumé Omnilex

The insured person appealed to the Federal Supreme Court against the Zug cantonal social insurance judgment concerning an electric bed as an invalidity-insurance aid. The court held that the appeal did not meet the mandatory reasoning requirements: it did not adequately explain any legal error or challenge the factual findings in a legally relevant way. In simplified proceedings, the court therefore did not enter into the appeal. Owing to the circumstances, it waived court costs.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; inadmissibility for lack of sufficient reasoning. An appeal to the Federal Supreme Court must, in condensed form, set out the relief sought and the reasons showing how the contested decision violates law. It is insufficient to advance submissions that do not address the subject matter of the dispute or that fail to explain, in a legally relevant manner, why the factual findings are incorrect and the ensuing legal conclusions unlawful. Where these minimal requirements are manifestly not met, the court may refuse to enter into the appeal in simplified procedure. Under Art. 66 Abs. 1 second sentence BGG, costs may exceptionally be waived for equitable reasons.

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Nussbaumer.

Verfahrensbeteiligte
M.________,
Beschwerdeführer,

gegen

IV-Stelle Zug, Baarerstrasse 11, 6300 Zug,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,

Question juridique clé

Whether the appeal met the reasoning requirements of Art. 42 BGG and could be examined on the merits.

Solution extraite

The appeal did not satisfy the minimum reasoning requirements because it did not show in what respect the challenged decision violated federal law or why the facts were allegedly incorrect.

Motifs extraits

The submissions were largely outside the dispute and did not meaningfully challenge the factual findings under Art. 97(1) BGG or the legal reasoning based on them; therefore simplified non-entry under Art. 108(1)(b) BGG was appropriate.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court costs were levied in the circumstances.

Motifs extraits

The court exercised discretion under Art. 66(1) second sentence BGG and waived costs for equitable reasons.
