Résumé Omnilex

The appellant challenged a Federal Administrative Court judgment in an invalidity insurance matter, arguing that his medical condition prevented work and submitting new medical evidence. The Federal Supreme Court held that the appeal did not satisfy the statutory reasoning requirements: it failed to show with sufficient specificity why the finding of 70% residual work capacity was manifestly incorrect or unlawful. The new medical documents were inadmissible because they were filed after the impugned judgment and no exceptional grounds for new evidence were substantiated. The appeal was therefore declared inadmissible in simplified proceedings, and no court costs were levied.

Regeste Omnilex

Art. 42 cpv. 1-2, art. 97 cpv. 1, art. 99 cpv. 1 e art. 108 cpv. 1 lett. b LTF; admissibility of the federal appeal in social insurance matters. A complaint that merely restates medical complaints and disagrees with the assessment of work capacity does not satisfy the duty to reason if it does not specifically demonstrate that the factual findings are manifestly inaccurate, arbitrary, or unlawful and outcome-determinative. Evidence produced only after the challenged judgment is inadmissible absent substantiated exceptional grounds under Art. 99(1) LTF. In such a case, the appeal may be disposed of summarily as inadmissible; costs may be waived under Art. 66(1) second sentence LTF.

Oggetto

1.
Il ricorso è inammissibile.

2.
Non si prelevano spese giudiziarie.

3.
Comunicazione alle parti, al Tribunale amministrativo federale,
Corte III, e all'Ufficio federale delle assicurazioni sociali.

Question juridique clé

Whether the federal appeal met the minimum reasoning requirements and could challenge the finding of 70% residual work capacity.

Solution extraite

The appeal did not explain in a legally sufficient manner why the lower court's factual findings were manifestly inaccurate or unlawful.

Motifs extraits

Under Art. 42 and Art. 97 LTF, the appellant must specifically show how the findings were arbitrary or unlawful and outcome-determinative; mere disagreement with medical assessments is insufficient.

Question juridique clé

Whether new medical documents filed with the appeal could be considered.

Solution extraite

The new documents were not admissible because they post-dated the challenged judgment and no exceptional grounds for new evidence were shown.

Motifs extraits

Art. 99(1) LTF requires a substantiated showing of the conditions for exceptional admission of new evidence, which was missing.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court costs were levied.

Motifs extraits

Under Art. 66(1) second sentence LTF, costs were waived.
