Résumé Omnilex

The appellant challenged a cantonal social insurance judgment concerning health insurance before the Federal Supreme Court. The Court held that the appeal failed to meet the mandatory requirements of Art. 42 BGG because it contained neither a proper prayer for relief nor an adequate explanation of legal error. As the defect was obvious, the Court applied the simplified procedure under Art. 108(1)(b) BGG and declined to set a time limit for correction. The appeal was therefore not entered into, and no court costs were imposed.

Regeste Omnilex

Question juridique clé

Whether the federal appeal satisfied the formal requirements of Art. 42 BGG.

Solution extraite

No; the filing did not contain a legally sufficient request and did not explain in a comprehensible way why the challenged decision violated the law.

Motifs extraits

Under Art. 42(1)-(2) BGG, an appeal must include prayers for relief and reasoning showing legal error. The submission failed these minimum requirements, so the Court could not examine the merits.

Question juridique clé

Whether the appeal should be entered into after an opportunity to cure the defects.

Solution extraite

No; the Court proceeded under the simplified procedure and did not grant a time limit for rectification.

Motifs extraits

Because the deficiency was manifest, the Court declined to set a deadline for amendment and refused entry on the appeal under Art. 108(1)(b) BGG.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court costs were imposed in the circumstances.

Motifs extraits

Applying Art. 66(1) second sentence BGG, the Court waived costs as an exception in view of the case circumstances.
