Résumé Omnilex

The claimant appealed a cantonal judgment on supplementary benefits to AHV/IV, but the Federal Court held that the written submission did not meet the statutory reasoning requirements. The appeal failed to engage sufficiently with the cantonal court's view that no legal basis existed for extending the pension-carrying exemption applicable to asset depletion to income treatment of a pension. The Federal Court therefore did not enter into the appeal in simplified proceedings and waived court costs.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG: an appeal must identify, in concise but concrete form, the legal errors alleged against the challenged decision; mere disagreement or abstract assertions do not suffice. The statement of reasons must address the decisive considerations of the lower court and show why they are unlawful (consid. 1). If this requirement is not met, the Federal Court may decline to enter into the matter in simplified proceedings. Costs may be waived exceptionally under Art. 66 Abs. 1 BGG.

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 30.

in Erwägung,

Question juridique clé

Whether the appeal satisfied the Federal Supreme Court's reasoning requirements under Art. 42 BGG.

Solution extraite

The appeal did not contain sufficient reasoning because it failed to engage with the cantonal court's grounds in a substantive and specific manner.

Motifs extraits

Under Art. 42(1)-(2) BGG, an appeal must explain in a concise form how the challenged decision violates the law. The submission did not show in which respects and why the cantonal judgment was attacked, especially regarding the treatment of occupational pension benefits as income and the absence of a legal basis for the proposed calculation method.

Question juridique clé

Whether the Federal Court should enter into the appeal in simplified proceedings.

Solution extraite

No entry was made on the appeal in simplified proceedings.

Motifs extraits

Because the appeal was insufficiently reasoned, the conditions for review were not met and non-entry followed under Art. 108(1)(b) BGG.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court costs were imposed due to the circumstances of the case.

Motifs extraits

The court exercised discretion and waived costs.
