Résumé Omnilex

The Federal Supreme Court did not enter into the appellant's challenge against the Zurich Social Insurance Court judgment because the submission failed to satisfy the statutory requirements of reasoning and requests. The court found that the appeal did not explain any unlawful factual findings or legal errors in the lower court decision. In the simplified procedure, it also waived court costs in view of the circumstances.

Regeste Omnilex

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; non-compliance with formal appeal requirements. An appeal must contain specific conclusions and a reasoned legal critique of the challenged decision; a mere disagreement with the result is insufficient. The appellant must, in a concise but intelligible manner, indicate why the contested findings of fact are arbitrary or otherwise unlawful and why the reasoning violates federal law (consid. 1). If these minimum requirements are not met, the court shall not enter into the appeal in simplified procedure. Court costs may exceptionally be waived under Art. 66 Abs. 1 second sentence BGG where the circumstances so warrant (consid. 2).
