Résumé Omnilex

The Federal Supreme Court dismissed the disability insurance appeal at the admissibility stage. It held that the submission did not satisfy the statutory reasoning requirements, as it failed to explain concretely why the cantonal court’s factual findings or legal assessment were wrong. The appellant’s argument regarding a 20% deduction was unavailing because a 25% deduction had already been granted. The court therefore issued a non-entry decision, waived court costs, and noted that the request for legal aid had become moot.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; non-entry for insufficient reasoning: A federal appeal is admissible only if the submissions, in concise form, set out how the challenged decision violates law. Where the appellant contests factual findings, it must specifically show arbitrariness or other unlawfulness in the determination of facts. A merely abstract or repetitive critique does not meet the pleading burden. If the appeal manifestly fails these requirements, the court may decide in simplified procedure not to enter into the matter. Where no court costs are imposed under Art. 66 Abs. 1 sentence 2 BGG, a pending request for legal aid becomes moot.

Urteil vom 25. März 2011
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Schmutz.

Verfahrensbeteiligte
M.________, vertreten durch Beratungsstelle für Ausländer,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich,
Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

September 2010,

in Erwägung,

Question juridique clé

Whether the appeal met the minimum reasoning requirements under Art. 42 BGG and Art. 97 BGG

Solution extraite

The appeal did not satisfy the minimum reasoning requirements because it did not show why the factual findings were incorrect or the legal reasoning unlawful.

Motifs extraits

The submissions did not concretely challenge the factual findings or explain legal error. The requested disability-related deduction had already been granted, so that argument was irrelevant.

Question juridique clé

Whether court costs should be levied

Solution extraite

No court costs were levied.

Motifs extraits

Under Art. 66 Abs. 1 sentence 2 BGG, the court waived costs in the non-entry procedure.

Question juridique clé

Whether the request for legal aid became moot

Solution extraite

The request for legal aid became moot because no court costs were imposed.

Motifs extraits

Since the proceedings resulted in no court costs, the application for free legal aid had no practical object.
