Résumé Omnilex

The insured woman challenged the refusal of disability benefits. The IV office had denied the claim, and the cantonal court upheld that refusal after finding an invalidity degree of 24.8% in a mixed household/gainful-work assessment. The Federal Supreme Court held that the complaint did not show any manifest factual error or violation of federal law, especially regarding the evaluation of medical evidence, household limitations, and alleged worsening of health. The appeal was dismissed in simplified procedure, and court costs of CHF 500 were charged to the appellant.

Regeste Omnilex

Art. 28 IVG, Art. 8 Abs. 3 ATSG, Art. 16 ATSG; mixed-method assessment of invalidity and scope of review under Art. 105 Abs. 2 BGG: In cases involving combined gainful and household activity, the degree of invalidity is determined by weighing the respective spheres according to the established activity ratio. A disability pension requires a pension-entitling degree of invalidity; where the lower court’s medical and household-evaluation findings are not shown to be manifestly incorrect, the Federal Supreme Court will not interfere. Alleged deterioration of health must be substantiated and can be rejected if the cantonal findings are not arbitrary or otherwise contrary to federal law (consid. 2). Manifestly unfounded appeals may be decided in simplified procedure under Art. 109 BGG, with costs following the outcome.

Urteil vom 19. Juni 2007
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Bundesrichter Lustenberger, Seiler,
Gerichtsschreiber Scartazzini.

Parteien
M.________ Beschwerdeführerin,

gegen

IV-Stelle Schwyz, Postfach 53, 6431 Schwyz, Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

23. Februar 2007.

Sachverhalt:
A.

1.

Question juridique clé

Whether the insured had a pension-entitling degree of invalidity.

Solution extraite

The insured did not reach the threshold for a disability pension; the invalidity degree was 24.8%.

Motifs extraits

The cantonal court's assessment of the medical evidence and household investigation was not shown to be manifestly incorrect. Given the mixed activity ratio of 75% homemaking and 25% gainful work, the demonstrated limitations still resulted in a non-rent-entitling degree of invalidity.

Question juridique clé

Whether the cantonal court's findings on health deterioration and cooperation duties were obviously गलत or contrary to federal law.

Solution extraite

No. The appellant failed to show any manifest factual error or violation of federal law.

Motifs extraits

The complaint did not substantiate why the lower court's factual findings or its evaluation of work and household capacity were unsustainable under the limited review of the Federal Supreme Court.

Question juridique clé

Costs of the federal proceedings.

Solution extraite

Court costs of CHF 500 were imposed on the appellant.

Motifs extraits

As the complaint was manifestly unfounded and dismissed in simplified procedure, the costs followed the outcome.
