The appellant sought federal review of a cantonal social-insurance judgment concerning slight helplessness, but his appeal and subsequent corrective filing failed to satisfy the minimum pleading requirements. Because he did not engage with the decisive reasoning of the cantonal court, the Federal Court found no valid appeal and, in summary procedure, declined to enter into the matter. It also refused free legal aid, but waived court costs given the circumstances. The decision was notified to the parties, the cantonal court, and the Federal Office for Social Insurance.

A federal appeal must contain specific requests and a concise, issue-related reasoning showing how the challenged decision violates federal law; a merely abstract or non-case-specific critique is insufficient. The appellant must engage with the decisive considerations of the lower court and explain, with reference to the contested findings, why they are erroneous or unlawful. If these minimum requirements are not met and no valid appeal is filed within the time limit, the court may decide in summary procedure not to enter into the matter (consid. 1). In such circumstances, free legal aid is excluded and costs may exceptionally be waived under Art. 66 Abs. 1 in fine BGG.

in die Beschwerde vom 22. Dezember 2008 (Poststempel) gegen den Entscheid des Verwaltungsgerichtes des Kantons Graubünden vom 31. Oktober 2008,
in die Mitteilung des Bundesgerichtes vom 29. Dezember 2008 an K.________, wonach seine Beschwerde die gesetzlichen Formerfordernisse nicht zu erfüllen scheint und eine Verbesserung nur innert Beschwerdefrist möglich ist,
in die daraufhin dem Bundesgericht am 3. Januar 2009 (Poststempel) eingereichte Eingabe des K.________,

in Erwägung,
dass ein Rechtsmittel gemäss Art. 42 Abs. 1 BGG unter anderem die Begehren und deren Begründung mit Angabe der Beweismittel zu enthalten hat, wobei im Rahmen der Begründung in gedrängter Form darzulegen ist, inwiefern der angefochtene Entscheid Recht verletzt (Art. 42 Abs. 2 BGG); die Vorbringen müssen sachbezogen sein, damit aus der Beschwerdeschrift ersichtlich ist, in welchen Punkten und weshalb der angefochtene Entscheid beanstandet wird (BGE 134 II 244 E. 2.1 S. 245; 131 II 449 E. 1.3 S. 452; 123 V 335 E. 1 S. 337 f.),
dass beide Eingaben diesen inhaltlichen Mindestanforderungen offensichtlich nicht genügen, da sich der Beschwerdeführer auch nicht ansatzweise mit den entscheidwesentlichen Erwägungen der Vorinstanz auseinandersetzt und den am vorinstanzlichen Prozessthema der (leichten) Hilflosigkeit vorbeizielenden Ausführungen nicht entnommen werden kann, inwiefern die Sachverhaltsfeststellungen im Sinne von Art. 97 Abs. 1 BGG unzutreffend und die darauf beruhenden Erwägungen rechtsfehlerhaft sein sollen,
dass deshalb mangels einer fristgerecht eingereichten gültigen Beschwerde die unentgeltliche Rechtspflege ausscheidet (Art. 64 BGG) und im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. b BGG auf die Beschwerde nicht einzutreten ist, wobei in Anwendung von Art. 66 Abs. 1 in fine BGG umständehalber auf die Erhebung von Gerichtskosten verzichtet wird,

erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.

Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird den Parteien, dem Verwaltungsgericht des Kantons Graubünden und dem Bundesamt für Sozialversicherungen schriftlich mitgeteilt.
