Résumé Omnilex

The Federal Supreme Court, in a simplified procedure, did not enter into G.'s appeal against the Bern cantonal social insurance judgment because the filing lacked any proper request and did not sufficiently explain any legal or factual error. The request for free legal aid was rejected as the appeal was hopeless, and court costs of CHF 200 were imposed on G. The decision was communicated to the parties, the cantonal court, the beco Berner Wirtschaft, Arbeitsvermittlung, and the State Secretariat for Economic Affairs.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG, Art. 97 Abs. 1 BGG, Art. 108 Abs. 1 lit. b BGG; requirements for admissible appeal and non-entry in simplified proceedings. An appeal must contain a clear prayer for relief and a concise, substantiated explanation indicating in what respect the challenged decision violates federal law; mere criticism or unsupported assertions are insufficient. If the pleading manifestly fails to meet these minimum requirements, the Federal Supreme Court may decline to enter into the matter under Art. 108 Abs. 1 lit. b BGG. Where the appeal lacks prospects of success, legal aid is to be refused under Art. 64 Abs. 1 BGG, and the unsuccessful appellant bears the costs pursuant to Art. 66 Abs. 1 and 3 BGG.

Parteien
G.________,
Beschwerdeführer,

gegen

Arbeitslosenkasse SYNA,
Zentralverwaltung, Josefstrasse 59,
8005 Zürich,

Gegenstand
Arbeitslosenversicherung,

Beschwerde gegen den Entscheid des Verwaltungsgerichts des Kantons Bern
vom 13. Oktober 2008.

Nach Einsicht
in die Beschwerde vom 20. November 2008 (Poststempel) gegen den Entscheid des Verwaltungsgerichts des Kantons Bern, Sozialversicherungsrechtliche Abteilung, vom 13. Oktober 2008,

in Erwägung,

Question juridique clé

Whether the appeal met the formal requirements of Art. 42 BGG and Art. 97 BGG

Solution extraite

The appeal did not contain a proper request or a sufficient explanation showing why the challenged findings of fact or the legal reasoning were erroneous.

Motifs extraits

The filing failed to satisfy the minimum content requirements for an appeal, so the court could not examine it on the merits.

Question juridique clé

Whether the Federal Supreme Court could enter into the appeal under Art. 108 BGG

Solution extraite

No; the appeal was treated as querulous and was not entered into in simplified proceedings.

Motifs extraits

Because the pleading was manifestly insufficiently reasoned, non-entry was appropriate under the simplified procedure.

Question juridique clé

Whether the appellant was entitled to free legal aid

Solution extraite

The request for waiver of costs was denied because the appeal had no prospect of success.

Motifs extraits

Under Art. 64 BGG, lack of prospects excludes unentgeltliche Rechtspflege.

Question juridique clé

Who bears the court costs

Solution extraite

The appellant was ordered to pay court costs.

Motifs extraits

Under Art. 66 BGG, the losing party bears the costs.
