Résumé Omnilex

The claimant appealed a Basel-Stadt social insurance judgment to the Federal Supreme Court. The complaint was filed within the time limit but did not satisfy the statutory reasoning requirements because it failed to explain concretely how the challenged decision violated the law. The request to extend the filing time was denied since the appeal period is statutory and non-extendable. As the appeal was manifestly inadmissible, the court did not enter into it and also rejected the request for free legal assistance. No court costs were levied.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 47 Abs. 1 BGG; Art. 64 BGG; Art. 108 Abs. 1 lit. b BGG: A federal complaint must contain a specific, issue-related prayer and concise reasoning showing in what respect the contested decision violates federal law. A merely abstract or non-targeted submission is insufficient and cannot be cured by a time extension; the statutory appeal period is non-extendable. Where the appeal is manifestly inadmissible, the court may decide under the simplified procedure. Free legal assistance is excluded if the proceedings lack prospects of success. In exceptional circumstances the court may waive costs (consid. 1-4).

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts Basel-Stadt
vom 11. Oktober 2007.

In Erwägung,
dass H.________ am 1. Februar 2008 (Poststempel) Beschwerde gegen den Entscheid des Sozialversicherungsgerichts Basel-Stadt vom 11. Oktober 2007 erheben liess,

Question juridique clé

Whether the federal complaint met the reasoning requirements of Art. 42 BGG

Solution extraite

No. The complaint did not state in a sufficiently specific and issue-related way how the challenged judgment violated the law.

Motifs extraits

Art. 42(1) and (2) BGG require requests and concise reasoning showing where and why the decision is unlawful; the filing plainly failed to meet that standard.

Question juridique clé

Whether the time limit for filing the complaint could be extended

Solution extraite

No. The 30-day statutory deadline could not be extended.

Motifs extraits

The complaint and grounds had to be filed within the statutory appeal period; that period had already expired, and the law excludes extension of this deadline.

Question juridique clé

Whether free legal assistance should be granted

Solution extraite

No. The appeal was hopeless, so free legal assistance had to be refused.

Motifs extraits

Because the complaint was manifestly inadmissible, the proceedings lacked prospects of success within the meaning of Art. 64 BGG.

Question juridique clé

Whether court costs should be charged

Solution extraite

No court costs were levied in view of the circumstances.

Motifs extraits

The court exercised its discretion under the costs provision and refrained from imposing fees.
