GastroSocial Pensionskasse appealed against a Basel-Stadt social insurance judgment that had upheld the IV office's decision only under an 'obvious error' standard. The Federal Court held that the cantonal social insurance court had improperly narrowed its review: under Art. 61 lit. c ATSG it must examine the appeal with full factual and legal cognition. The case-law on the binding effect of IV findings in later BVG proceedings does not apply to restrict review in the IV appeal itself. The Federal Court therefore annulled the cantonal judgment and remitted the matter for a new decision, without charging court costs.

The jurisprudence on the binding effect of IV findings for subsequent BVG proceedings governs only the extent to which finalized IV findings bind later occupational pension litigation; it does not authorize restriction of review in the IV appeal itself. If the cantonal court applies an impermissibly narrow standard, its judgment must be annulled and the matter remitted for fresh adjudication (consid. 1).

Nach Einsicht
in den Entscheid des Sozialversicherungsgerichts Basel-Stadt vom 10. Juli 2008, worin das kantonale Gericht die vom Vorsorgeversicherer gegen die Verfügung vom 12. September 2007 der IV-Stelle Basel-Stadt beschwerdeweise vorgebrachten Einwände (Zeitpunkt der Eröffnung der Wartezeit; sich aus dem Gesundheitsschaden ergebende Erwerbsunfähigkeit) unter dem Blickwinkel der offensichtlichen Fehlerhaftigkeit abhandelte und als unbegründet abwies,
in die dagegen erhobene Beschwerde in öffentlich-rechtlichen Angelegenheiten und die Akten,

in Erwägung,
dass gemäss Art. 61 lit. c ATSG das kantonale Sozialversicherungsgericht mit umfassender Kognition ausgestattet ist, es sich indessen vorliegend beim Prüfen der vom Vorsorgeversicherer in der Beschwerde in legitimierter Weise (BGE 132 V 1 E. 3.2 S. 4; 130 V 270 E. 3.1 S. 273; 129 V 150 E. 2.5 S. 156) vorgebrachten Rügen auf eine offensichtige Unrichtigkeit der von der IV-Stelle vorgenommenen Sachverhaltsfeststellung und Rechtsanwendung beschränkt hat,
dass es hierfür indessen keine rechtliche Handhabe gibt,
dass sich dies insbesondere nicht der Rechtsprechung zur Bindungswirkung der Feststellungen der IV-Organe für den Beginn und die Höhe des Anspruchs auf eine BVG-Invalidenrente entnehmen lässt, wovon die Vorinstanz auszugehen scheint (E. 4a des angefochtenen Entscheids),
dass diese vielmehr lediglich regelt, unter welchen Voraussetzungen und gegebenenfalls inwieweit im rechtskräftig abgeschlossenen IV-Verfahren getroffene Feststellungen für das regelmässig später stattfindende BVG-Verfahren bindend sind (vgl. BGE 130 V 270 E. 3.1 S. 273),
dass dergestalt das kantonale Gericht über die Beschwerde der Vorsorgeeinrichtung nochmals und mit voller Sachverhalts- und Rechtskontrolle zu befinden hat,

dass in Anwendung von Art. 66 Abs. 1 Satz 2 BGG auf die Erhebung von Gerichtskosten verzichtet wird,

erkennt das Bundesgericht:

Die Beschwerde wird in dem Sinne gutgeheissen, dass der Entscheid des Sozialversicherungsgerichts Basel-Stadt vom 10. Juli 2008 aufgehoben und die Sache an die Vorinstanz zurückgewiesen wird, damit sie im Sinne der Erwägungen verfahre und über die Beschwerde gegen die Verfügung vom 12. September 2007 neu entscheide.

Es werden keine Gerichtskosten erhoben.

Dieses Urteil wird den Parteien, dem Sozialversicherungsgericht Basel-Stadt und dem Bundesamt für Sozialversicherungen schriftlich mitgeteilt.
