Résumé Omnilex

The appellant challenged a cantonal judgment in unemployment insurance proceedings, but his federal appeal did not contain any request and failed to engage with the cantonal reasoning. The Federal Supreme Court held that the filing did not satisfy the minimum requirements of Art. 42 BGG and therefore constituted no valid legal remedy. It consequently did not enter into the appeal under the simplified procedure of Art. 108(1)(b) BGG. In view of the circumstances, the court waived federal court costs.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; insufficiency of the statement of appeal and non-entry in simplified proceedings. An appeal must contain requests and a reasoned critique of the challenged decision; the appellant must engage with the decisive considerations and indicate, in a concise manner, which legal norms were allegedly violated. A filing that omits requests and merely expresses dissatisfaction without concrete confrontation with the reasoning of the lower court does not constitute a valid legal remedy. In such a case, the Federal Supreme Court may decline to enter into the matter under Art. 108 Abs. 1 lit. b BGG. Court costs may exceptionally be waived under Art. 66 Abs. 1 second sentence BGG, where the circumstances so justify.

Urteil vom 19. Juni 2014

I. sozialrechtliche Abteilung

Besetzung
Bundesrichterin Leuzinger, Präsidentin,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
A.________,
Beschwerdeführer,

gegen

Arbeitslosenkasse des Kantons Zürich,
Brunngasse 6, 8400 Winterthur,
Beschwerdegegnerin.

Gegenstand
Arbeitslosenversicherung (Prozessvoraussetzung),

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 30. April 2014.

April 2014,

in Erwägung,

Question juridique clé

Whether the federal appeal met the formal reasoning requirements of Art. 42 BGG.

Solution extraite

No; the appeal did not contain any request and did not engage concretely with the cantonal court's reasoning.

Motifs extraits

A valid appeal must state requests and explain briefly how the challenged decision violates law. The filing failed to address the lower court's reasoning on insolvency compensation or to show any legal error.

Question juridique clé

Whether the appeal was admissible under Art. 108(1)(b) BGG.

Solution extraite

No; because no valid legal remedy had been filed, the appeal was manifestly inadmissible.

Motifs extraits

The deficient filing could not be treated as a proper appeal, so summary non-entry under the simplified procedure was appropriate.

Question juridique clé

Whether court costs should be charged for the federal proceedings.

Solution extraite

No court costs were levied due to the circumstances.

Motifs extraits

The court exercised discretion under Art. 66(1) second sentence BGG to waive costs.
