Résumé Omnilex

The insured person appealed a Solothurn social insurance judgment to the Federal Supreme Court. After being asked to cure a missing attachment and later warned that the appeal seemed insufficiently reasoned, she filed a further submission. The Court held that the appeal did not satisfy the requirements of Art. 42 BGG because it did not concretely engage with the decisive reasoning of the cantonal court, especially its assessment of evidence. The appeal was therefore manifestly inadmissible and no entry was made under Art. 108 Abs. 1 lit. b BGG. In the circumstances, the Court exceptionally waived court costs.

Regeste Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; form requirements of the appeal and summary non-entry: an appeal must contain a prayer and, in a concise yet specific manner, reasons showing how the challenged decision violates federal law. The appellant must engage with the decisive considerations of the lower court; merely abstract or general criticism is insufficient. In particular, where the contested judgment rests on evidence appreciation, the complaint must identify the alleged legal error or constitutionally relevant factual defect with reference to the reasoning attacked. If these minimum requirements are not met, the appeal is manifestly inadmissible and may be decided in summary procedure by the presiding judge (consid. 1).

Urteil vom 1. Juni 2011
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
R.________,
Beschwerdeführerin,

gegen

IV-Stelle des Kantons Solothurn, Allmendweg 6, 4528 Zuchwil,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

in Erwägung,

Question juridique clé

Whether the appeal met the formal requirements of Art. 42 BGG, especially a proper prayer and reasoned challenge to the cantonal judgment.

Solution extraite

The submissions did not sufficiently address the decisive reasoning of the cantonal court and therefore did not constitute a valid appeal.

Motifs extraits

The appellant failed to explain concretely how the cantonal court violated federal law or made manifestly incorrect findings of fact; the arguments were not case-specific and did not engage with the evidence assessment.

Question juridique clé

Whether the Federal Supreme Court could enter into the appeal under Art. 108 Abs. 1 lit. b BGG.

Solution extraite

No entry was possible because the appeal was manifestly inadmissible.

Motifs extraits

As the appeal lacked the required substantiated reasoning, it had to be dismissed in summary procedure by the division president.

Question juridique clé

Whether court costs should be charged.

Solution extraite

Court costs were exceptionally waived.

Motifs extraits

Given the circumstances, the Court departed from the usual rule and refrained from charging costs under Art. 66 Abs. 1 sentence 2 BGG.
