Résumé Omnilex

The Federal Court did not enter into the insured person's appeal against the Zurich Social Insurance Court judgment concerning waiver of repayment of an overpaid July accident-insurance pension. It held that the appeal failed to meet the reasoning requirements of Art. 42 BGG because it did not address the lower court's decisive finding that good faith was lacking. The appellant's financial hardship argument was therefore insufficient. To the extent the filing also sought a widow's pension, the matter was not part of the appeal and was forwarded to SUVA for further handling. No court costs were levied.

Regeste Omnilex

Art. 42 BGG; requirements of substantiated reasoning in a federal appeal; Art. 108 Abs. 1 lit. a and b BGG; a remedy is inadmissible when it does not engage concretely with the decisive reasons of the challenged judgment and remains merely appellatory. If the lower court denies good faith, an argument limited to financial hardship does not suffice to challenge the refusal of waiver. Requests falling outside the subject matter of the appeal are not examined and may be forwarded to the competent first-instance authority. Under Art. 66 Abs. 1 sentence 2 BGG, costs may be waived.

Urteil vom 3. Mai 2013
I. sozialrechtliche Abteilung

Besetzung
Bundesrichterin Leuzinger, Präsidentin,
Gerichtsschreiber Grünvogel.

Verfahrensbeteiligte
T.________,
Beschwerdeführer,

gegen

Schweizerische Unfallversicherungsanstalt (SUVA), Fluhmattstrasse 1, 6004 Luzern,
Beschwerdegegnerin.

Gegenstand
Unfallversicherung (Prozessvoraussetzung),

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 18. Februar 2013.

Februar 2013,

in Erwägung,

Question juridique clé

Whether the federal appeal satisfied the reasoning requirements under Art. 42 BGG

Solution extraite

No. The appeal did not engage sufficiently with the decisive reasoning of the lower court and remained purely appellatory.

Motifs extraits

The appellant merely relied on his strained finances, while the cantonal court had rejected good faith and therefore did not need to examine grave hardship. Under Art. 42 BGG, the appeal had to address those reasons concretely.

Question juridique clé

Whether the request for a widow's pension could be dealt with in this appeal

Solution extraite

No. That request was outside the scope of the proceedings and had to be handled by SUVA in the first instance.

Motifs extraits

The court stated that the widow's pension request could not be introduced for the first time in the present appeal and therefore forwarded the filing to SUVA.

Question juridique clé

Whether court costs should be charged

Solution extraite

No court costs were levied.

Motifs extraits

The court waived costs under Art. 66(1) sentence 2 BGG.
