8C_128/2011 ΓÇó Non-entry for missing attachments and defective appeal
8C_128/2011Tribunal fédéral / IVe division de droit public24 févr. 2011Inadmissible
The Federal Supreme Court held that the appellant failed to remedy the formal defect identified in the court’s notice, namely the absence of the challenged decision, and that the filing also did not otherwise satisfy the requirements for an appeal. It therefore refused to enter into the matter in simplified procedure. Because of the procedural posture, the court waived court costs. The decision was communicated in writing to the appellant.
Art. 42 Abs. 2 and 5 BGG; Art. 108 Abs. 1 lit. a BGG; non-entry for uncured formal defects in the appeal: where the appellant fails to remedy a defect notified by the court within the set time limit, in particular by submitting the missing documents, and the filing still does not meet the further requirements of an appeal, the court may declare the appeal inadmissible in simplified procedure. In such a case, costs may be waived under Art. 66 Abs. 1 second sentence BGG.
