The appellant withdrew his nullity appeal by a letter posted on 2007-04-20. The Criminal Cassation Court therefore struck the case from the roll and ordered that no judicial fee be charged. The order was communicated to the appellant, the Fribourg public prosecutor, and the cantonal appellate criminal court.
Withdrawal of a nullity appeal; the appellate court strikes the case from the roll once the appellant validly withdraws the remedy. In such circumstances, no further examination on the merits is required, and the court may dispense with judicial fees where it so orders in the dispositive part.
