Résumé Omnilex

The Federal Supreme Court rejected the applicant’s request to revise its earlier judgment that had not entered into his complaint for lack of standing. The court held that the applicant failed to invoke any applicable statutory revision ground and that his submissions were largely irrelevant or plainly unfounded. It further noted that, because the earlier complaint was dismissed for formal reasons, the court had no duty to examine the merits or the specific requests for relief. The applicant was ordered to pay the court fee of CHF 1,000.

Regeste Omnilex

Arts. 121-123 BGG; revision of a Federal Supreme Court judgment: the grounds for revision are exhaustively enumerated and must be substantiated with concrete, legally relevant arguments. General criticism of the prior judgment or submissions unrelated to a statutory ground are inadmissible. Where the earlier judgment was a non-entry decision for formal reasons, there is no omission to decide the merits or the prayers for relief within the meaning of Art. 121 BGG. Costs are imposed on the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 7. Oktober 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, präsidierendes Mitglied,
Bundesrichter Ferrari, Mathys,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Gesuchsteller,

gegen

Staatsanwaltschaft des Kantons Basel-Stadt, 4001 Basel,
Gesuchsgegnerin.

Gegenstand
Revision des bundesgerichtlichen Urteils 6B_637/2009.

Das Bundesgericht zieht in Erwägung:

1.

Question juridique clé

Whether the revision request met any statutory revision ground under the Federal Supreme Court Act.

Solution extraite

The request did not show any applicable revision ground; the arguments were largely irrelevant or manifestly unfounded.

Motifs extraits

Revision grounds are exhaustively listed in Arts. 121-123 BGG. The applicant did not demonstrate that decisive facts had been overlooked, and his criticism of the prior judgment was mostly general and unrelated.

Question juridique clé

Whether the applicant could challenge the prior non-entry decision on standing and omitted requests.

Solution extraite

No. The prior court had to dismiss the complaint for formal reasons, so it did not need to address the merits or the prayers for relief.

Motifs extraits

Because the earlier complaint was inadmissible for lack of standing, the court was not required to examine the substantive requests; the complaint-standpoint arguments under Art. 81 BGG were inapplicable.

Question juridique clé

Allocation of court costs for the revision proceedings.

Solution extraite

The applicant must bear the court fee.

Motifs extraits

Costs are charged to the unsuccessful party under Art. 66(1) BGG.
