Résumé Omnilex

The Federal Supreme Court considered a request for revision or interpretation of its earlier non-entry judgment of 18 March 2013. It held that the applicant's submissions did not establish any admissible ground for revision or clarification; a citation from the cantonal judgment did not show that the prior federal appeal had been sufficiently reasoned, and the remaining allegations merely challenged the assessment of the case and the conduct of a cantonal judge. The request was therefore dismissed insofar as it could be entered upon, and the applicant was ordered to pay CHF 1,000 in costs.

Regeste Omnilex

Art. 66 Abs. 1 BGG; Revision or interpretation of a Federal Supreme Court judgment is not a vehicle for rearguing the merits or for curing an inadequately reasoned appeal. A mere citation from a cantonal decision does not establish that the earlier federal appeal satisfied the statutory reasoning requirements. Submissions directed against the assessment of the case or the conduct of a cantonal judge do not constitute cognizable grounds for revision or interpretation (consid. 1-2).

Urteil vom 23. April 2013

Besetzung
Bundesrichter Mathys, Präsident,
Bundesrichterin Jacquemoud-Rossari,
Bundesrichter Oberholzer,
Gerichtsschreiber C. Monn.

Generalstaatsanwaltschaft des Kantons Bern, Maulbeerstrasse 10, 3011 Bern,
Gesuchsgegnerin.

Gegenstand
Gesuch um Revision oder Erläuterung des Urteils
des Schweizerischen Bundesgerichts vom 18. März 2013 (6B_156/2013).

Das Bundesgericht zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Bern, Strafabteilung, 2. Strafkammer, schriftlich mitgeteilt.

Question juridique clé

Whether the request for revision or interpretation of the prior Federal Supreme Court judgment was admissible and well-founded

Solution extraite

The request was dismissed insofar as it could be entered upon; the applicant's arguments did not show any ground for revision or interpretation.

Motifs extraits

Referring to a prior remark that the applicant had not commented on whether the white-bordered area was a parking space, the Court held that a citation from the cantonal judgment could not prove that the earlier federal appeal had been sufficiently reasoned. The remaining submissions merely disputed the assessment of the case and a cantonal judge's conduct, which are not proper grounds for revision or interpretation.

Question juridique clé

Allocation of court costs

Solution extraite

The court costs were imposed on the applicant.

Motifs extraits

As the request failed, the applicant had to bear the costs under the Federal Supreme Court Act.
