Résumé Omnilex

X. challenged before the Federal Supreme Court a cantonal decision refusing to open criminal proceedings after a police intervention. The Court held that the submission did not satisfy the federal reasoning requirements, since it did not show any violation of Art. 95 BGG in a legally sufficient way. The complaint was therefore not entered into under the summary non-entry procedure. The Court exceptionally waived court costs, which rendered the request for free legal aid moot.

Regeste Omnilex

Art. 42 Abs. 2, Art. 106 Abs. 2, Art. 108 BGG; requirements for reasoning in a complaint to the Federal Supreme Court: the appeal must, in a substantiated manner, identify the contested reasoning and demonstrate, by reference to federal law, why it is unlawful. Mere annotations or general criticism of the challenged decision do not suffice. If the submission fails to meet these requirements, the Court does not enter into the matter in summary procedure under Art. 108 BGG. Where costs are exceptionally waived, a request for free legal aid becomes moot.

Urteil vom 7. Oktober 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft des Kantons St. Gallen, 9001 St. Gallen,
Beschwerdegegnerin.

Gegenstand

Question juridique clé

Whether the complaint against the refusal to open criminal proceedings was sufficiently reasoned under the Federal Supreme Court Act.

Solution extraite

The complaint did not explain, in a legally cognizable way, how the refusal to open proceedings violated federal law; the reasoning requirements were not met.

Motifs extraits

The marginal notes on the contested decision did not show any violation within the meaning of Art. 95 BGG. Therefore the complaint was inadmissible under the summary non-entry procedure.

Question juridique clé

Whether court costs should be charged and whether legal aid remained necessary.

Solution extraite

No court costs were levied as an exception, so the request for free legal aid became moot.

Motifs extraits

Because the court exceptionally waived costs, there was no remaining need to decide the legal-aid request.
